These Terms and Conditions (“the Terms and Conditions”) govern your use as “the User” of the Silvery (“Provider”) website located at the domain name www.silvery.com.au (“the Website”).

1.) Hand Stamping

Information you need to know before purchasing our hand stamping service.

The Process – Hand stamping as it’s said, is all done by hand and eye coordination. Each letter is carefully placed and stamped by a hammer, all done by hand. The alignment of the text will not be perfectly aligned and may differ in height especially on longer words.

Font Options  – We offer two sized fonts 3mm and 1.5mm. The width and height of each character is 3 or 1.5mm depending on what you have chosen.

Stamping Pressure – As each letter is stamped by hand, indentations may vary between each character. Some letters may look slightly bigger or bolder due to different stamping pressures done by hand.

Alignment – Letter will not be perfectly aligned, as this process is done by hand and each character placed and stamped it’s nearly impossible to get a perfect alignment.

Bar / Pendant Disfigurement – During the stamping process, bars/pendants may become bent or slightly disfigured. This is the nature of hand-stamping as you are forcing an impression into metal. The metal being forced inwards has to push out to the sides. Once the pendant or bar is complete we straighten the pendant as much as we can before damaging or weakening the metal.

If you are looking for perfectly engraved and aligned characters, then machine engraving would be a better choice. But for those people who are looking for a unique handmade product, then hand stamping is perfectly suited for you.

By accessing and using the Website, the User agrees to be bound by the Terms and Conditions set out in this legal notice. The User may not access, display, use, download, and/or otherwise copy or distribute Content obtained on the website for marketing and other purposes without the consent of the Provider.

2.) Electronic Communications

By using this Website or communicating with the Provider by electronic means, the user consents and acknowledges that any and all agreements, notices, disclosures, or any other communication satisfy any legal requirement, including but not limited to the requirement that such communications should be in writing.

3.) Returns and Refunds

As a brand that offers distinctively personalised service, our aim is to ensure that our customers are always satisfied with their purchases. Please contact our Team directly at ashton@silvery.co.za for any return or refund enquiries.

Returns and refunds are dealt with on a case-to-case basis as every order is unique. Our Team will work on the most convenient and satisfactory solution suited to your enquiry and assist you through the entire process. Breakages incur an additional cost that is specifically quoted for your enquiry.

It is important to note that generally, the following items are not eligible for a refund:
1. Personalised Items
2. Items that have been altered in any way since receipt.

When it comes to wear and tear on items Silvery does not offer a guarantee or warranty on products. This applies to all aspects of our products including those related to tarnishing and plating. We will still do our best to assist you through these situations.

Refunds are taken on a case-to-case basis. Please contact our Team directly at ashton@silvery.co.za to enquire further.

If you qualify for a refund, the refund will be processed using the same method of payment selected on your order. Delivery charges on your original order will not be refunded.

4.) Cancellation of Orders

Cancelled orders on the e-commerce facility will be refunded after deduction of a 10% charge for administration costs.

The Provider reserves the right to cancel an order for which payment has already been received. This may occur if stock is insufficient or the quality of goods ordered does not meet the Provider’s standards. Should the Provider exercise this right, the User will receive a full refund with no deductions.

5.) Payment Options

Payment may be made via Stripe or by bank transfer into the Provider’s bank account, the details of which will be provided during and after checkout.

  • CREDIT CARD ACQUIRING & SECURITY

Credit card transactions will be acquired for the Provider via Stripe. Stripe uses the 3D Secure standard—often known by its branded names like Visa Secure, Mastercard Identity Check, or American Express SafeKey—aims to reduce fraud and provide added security to online payments.

All our jewellery is crafted by our jewellers at our international crafting studio based in South Africa. Typically the time period to create your personalised item will take 2 – 3 working days. Once your order is completed we then ship your order to our Silvery team based in New South Wales Australia. When your order arrives at our station we ship your order the same day with the Australian Postal Services with the service you have selected.

*As we have a registered office in Australia there are no duties and taxes imposed on your order.


ORDER PROCESSING & DELIVERY

Crafting will be processed once we have received your payment. From receipt of payment dispatch takes 2 – 3 working days, during special occasions such as Christmas season and Valentine’s Day this may be extended by two working days due to the high volume of orders.

ORDER PROCESSING DELAYS & QUERIES

Order processing time may be delayed if we have any queries that we need to be clarified regarding your order. Please supply us with an email address in your order that is attended to.  If we can not make communication with you we will then try to call you on the contact number supplied when placing your order.

TRACKING NUMBER

Tracking numbers will be emailed to our customers once we have handed your package over for delivery.

DELIVERY ADDRESSES

Please note that DHL are not able to deliver to Post Boxes. We will also not be held responsible for incorrect delivery details supplied when checking out. Please note that if you select our courier option, somebody will need to sign for the parcel.

INTERNATIONAL DUTIES AND TAXES

For all international orders placed outside of South Africa, Silvery will not be held liable for import taxes and duties into your country. Customs policies vary greatly from country to country. Please research and understand the related charges you could be liable for prior to placing and ordering from Silvery.

CONDITION OF GOODS

Silvery will supply all goods to the delivery company in good order. You may request for us to take a picture which will be date stamped, of your items before they are sealed in their final packaging, but cannot ensure that the goods arrive at your chosen delivery address in the same good order and thus do not take responsibility for damage to items during transit.

7.) Merchant Outlet country and transaction currency

The merchant outlet country at the time of presenting payment options to the cardholder is South Africa. Transaction Currency is South African Rand (ZAR).

8.) Updating of these Terms and Conditions

Provider reserves the right to change, modify, add to or remove from portions or the whole of these Terms and Conditions from time to time. Changes to these Terms and Conditions will become effective upon such changes being posted to this Website. It is the User’s obligation to periodically check these Terms and Conditions at the Website for changes or updates. The User’s continued use of this Website following the posting of changes or updates will be considered notice of the User’s acceptance to abide by and be bound by these Terms and Conditions, including such changes or updates.

9.) Copyright and Intellectual Property Rights

Provider provides certain information at the Website. Content currently or anticipated to be displayed at this Website is provided by Provider, its affiliates and/or subsidiary, or any other third party owners of such content, and includes but is not limited to Literary Works, Musical Works, Artistic Works, Sound Recordings, Cinematograph Films, Sound and Television Broadcasts, Program-Carrying Signals, Published Editions and Computer Programs (“the Content”). All such proprietary works, and the compilation of the proprietary works are copyright the Provider, its affiliates or subsidiary, or any other third party owner of such rights (“the Owners”), and is protected by South African and international copyright laws. The Providers reserve the right to make any changes to the Website, the Content, or to products and/or services offered through the Website at any times and without notice. E-mail addresses, names, telephone numbers and fax numbers on the Website may not be incorporated into any database used for electronic marketing or similar purposes.

All rights in and to the Content is reserved and retained by the Owners. Except as specified in these Terms and Conditions, the User is not granted a license or any other right including without limitation under Copyright, Trademark, Patent or other Intellectual Property Rights in or to the Content.

10.) Limited License to General Users

Provider grants to the User, subject to the further terms of these Terms and Conditions, a non-exclusive, non-transferable, limited and revocable right to access, display, use, download and otherwise copy the current and future Content for personal, non-commercial and information purposes only.

This Website and the Content may not be reproduced, duplicated, copied, resold, visited or otherwise exploited for any commercial purpose without the express prior written consent of Provider. The license does not allow the User to collect product or service listings, descriptions or other information displayed here, and does not allow any derivative use of this Website or the Content for the benefit of another merchant. The User may not frame nor use framing technologies to enclose the Provider Website or the Content nor any part thereof without the express written consent of Provider. Provider and the Owners do not offer products or services to minors. If you are under the age of 18, you may not respond to or otherwise accept or act upon any offers in the Website.

The User agrees not to infect the Website with any computer programming (such as a virus) that may damage, interfere with, delay or intercept any data or information on the Website and the User agrees to pay for any monetary or other loss the Provider may incur as a result of such infection of the Website by the User.

The provider cannot guarantee that use of the Website will always be uninterrupted or that it is free from becoming infected by viruses due to factors beyond our control. Access to the Website may sometimes be restricted due to repairs or maintenance of the Website. The provider cannot assume any responsibility for the lack of functionality that is dependent on the User’s browser or other third party software.
